The reason they found out about this guy's collection was pretty much because he imported a fuckload of those mangas from Japan and the tollkeepers had their happy "open others' mail and see what's inside"-day since buying illegally acquired informations about peoples behaviour from Microsoft wasn't enough.

Anyway, this guys ass was busted for getting off to lolicon, making him the first one ever to get punished for owning fictional pieces of "art", some other countries (ok, it's only the Japs I think) consider it, making it comparable to being sent to psychiatry for playing Postal.

As much as I can laugh about that 40-year-old basement dweller and how his passion has become his fate, the fact that people can be put in jail for this is even more ridiculous.

the real underlying issue here is freedom of expression. no one is harmed in the making or reading of these, and for the government to act on that is a violation of basic human rights

Well, and that's pretty much the problem about it... Fictional characters' ages can not be defined. Anyone can draw a clearly underaged looking character, set the age himself and call it chibi style or some other shit like that which works the other way around as well, making the whole issue look even more pathetic if you imagine an entire court, discussing the age of a fictional anime character, created by the fantasy of a middle aged Japanese man.

the Child Pornography Prevention Act of 1996 made it a crime punishable by no less than 5 years for owning materials which show "any sexually explicit image that was advertised, promoted, presented, described, or distributed in such a manner that conveys the impression it depicts a minor engaging in sexually explicit conduct." And that was struck down because it bans speech which neither exploits children in the production process, nor is obscene. I don't understand how the courts came with this outcome. Worst lawyers ever I'm guessing.
